So technically my car was filed in the bankruptcy but the loan holder said if we continue to pay the loan it won't matter. They no longer send us statements and such. Anyways there have apparently been two months in which I did not pay the monthly payment (I believe December 2010 and February 2011). We found this out because my parents just ran their credit report and it was reported on there as a past due balance. Being as the car is part of the bankruptcy are they allowed to post past due payments on their credit-which brings their score down even further?

In Feb (2 months ago) I was rear ended at an intersection by a drunk driver. It was 3pm, I was on my way to class, and he hit me out of nowhere. This was his second offense. Lets say I have $100,000 dollars in coverage that covers me in case of theft or something like that. Being that the car was fully covered and insurance was able to pay back the loan, would they give me the money to buy a new car at equal or face value of the car that was stolen? Insurance is so friggin complicated...if someone could explain the process to me I'd appreciate it.

So technically my car was filed in the bankruptcy but the loan holder said if we continue to pay the loan it won't matter. They no longer send us statements and such. Anyways there have apparently been two months in which I did not pay the monthly payment (I believe December 2010 and February 2011). We found this out because my parents just ran their credit report and it was reported on there as a past due balance. Being as the car is part of the bankruptcy are they allowed to post past due payments on their credit-which brings their score down even further?
